Crimes Against Humanity Treaty Faces Crucial Turning Point

A landmark effort to close one of international law’s most persistent gaps is set to begin at United Nations Headquarters in New York. On January 19, 2026, formal discussions will open on a proposed Crimes Against Humanity Treaty, marking the first serious attempt in eight decades to establish a binding legal framework dedicated specifically to preventing and punishing these grave offences. Crimes such as extermination, torture, enslavement, and enforced disappearance already exist within international legal discourse. Prosecution, however, remains inconsistent because no standalone treaty obliges states to act. Absence of such a framework has allowed many perpetrators to evade accountability, leaving survivors without justice. Why a Dedicated Treaty Remains Urgently Needed Escalating global conflicts and geopolitical rivalries have weakened collective commitment to human rights norms. Power politics increasingly override legal principles, leaving civilian populations exposed to widespread abuses. In this environment, a Crimes Against Humanity Treaty would reaffirm international standards and create enforceable obligations for states. Ratifying states would be required to either prosecute suspects found within their jurisdiction or extradite them to face trial elsewhere. Such provisions would expand accountability pathways and reduce safe havens for perpetrators. Effectiveness, however, depends on whether the convention strengthens existing protections rather than merely restating current law. Historical Background and Legal Gaps Accountability for crimes against humanity first emerged after World War II through the Nuremberg Trials, where Nazi officials were prosecuted for atrocities committed during the Third Reich. Subsequent instruments such as the Geneva Conventions and the Genocide Convention addressed war crimes and genocide but stopped short of creating a dedicated treaty for crimes against humanity. Renewed attention surfaced during the 1990s with ad hoc tribunals for the former Yugoslavia and Rwanda . Momentum continued with the adoption of the Rome Statute in 1998, establishing the International Criminal Court, now supported by 122 member states. Even so, reliance on the ICC alone has proven insufficient. A significant step occurred in 2019 when the UN International Law Commission released Draft Articles on the Prevention and Punishment of Crimes Against Humanity, explicitly recommending negotiation of a binding treaty. Roadmap For Negotiations From 2026 To 2029 Consensus finally emerged in 2023, allowing negotiations to move forward after years of resistance from some states. General Assembly Resolution 79/122, adopted in 2024, set a three-year negotiation timeline. Key milestones include: January 2026: First Preparatory Committee meeting to discuss amendments and participation rules April 30, 2026: Deadline for states to submit amendment proposals 2027: Second preparatory session focused on procedure and leadership 2028 and 2029: Two intensive negotiating sessions to finalise the treaty text Outcomes from these stages will determine whether international law finally addresses crimes against humanity comprehensively or remains fragmented. State Positions And Political Divisions Roughly 100 countries have aligned in support of completing the treaty, led by Mexico and The Gambia. These states argue that existing mechanisms remain inadequate and that a binding convention would strengthen global accountability. Opposition comes from a smaller bloc including China, Russia, and Iran, which contend that negotiations are premature or unnecessary. Several other states remain undecided, seeking further justification. The position of the United States remains uncertain, with officials indicating ongoing internal review. Expanding Protections For Marginalised Groups Advocates are pushing for amendments that reflect contemporary realities of mass harm. Proposals include recognising crimes such as gender apartheid, forced marriage, and systematic abuses against persons with disabilities, groups historically underprotected in international criminal law. Recognition of these harms would align the treaty with modern human rights standards and ensure protection for populations previously overlooked. Importance Of Civil Society Participation Civil society involvement stands as a central issue in the January 2026 session. Decisions on whether organisations without ECOSOC accreditation may participate will reveal underlying power dynamics among states. Academics, activists, and non-governmental organisations contribute critical expertise grounded in real-world experience. Excluding these voices risks reinforcing perceptions that international law operates in isolation from those most affected by atrocities. Preserving Strong Operational Provisions Beyond expanding definitions, maintaining robust operational obligations within the Draft Articles remains essential. Weakening enforcement, cooperation, or jurisdictional provisions would undermine effectiveness regardless of how many crimes are listed. Success depends on resisting minimalist approaches and ensuring the treaty delivers real accountability. Setting A Meaningful Trajectory Forward Upcoming Preparatory Committee deliberations represent more than procedural steps. Choices made will shape whether negotiations advance toward a strong, inclusive, and enforceable Crimes Against Humanity Treaty or stall under political pressure. Allowing meaningful civil society participation and encouraging substantive amendments would help ensure the convention responds to present-day realities of mass violence and injustice.
