Court Ousts Türkiye Opposition Party Leadership Amid Crisis

Türkiye's opposition party leadership has faced a severe setback following a court ruling that removes the chair and executive members of the primary opposition party, the Republican People’s Party (CHP). This decision is yet another blow to democracy, human rights, and the rule of law in Türkiye, as highlighted by Human Rights Watch today. On May 21, 2026, the 36th Ankara regional court of appeal issued an interim order that effectively ousts CHP chair, Özgür Özel, along with the entire party leadership. This ruling invalidated the party congress that took place on November 4-5, 2023, where Özel was elected. The court reinstated the previous leader, Kemal Kılıçdaroğlu, who lost the presidential race to President Recep Tayyip Erdoğan in May 2023. According to Benjamin Ward, deputy Europe and Central Asia director at Human Rights Watch, the court's ruling to dismiss Özgür Özel and the entire CHP leadership reveals a trend in the Erdoğan administration to weaken political opposition, significantly infringing upon civil and political rights and undermining Türkiye's democratic processes. “Following the imprisonment of Istanbul mayor and CHP presidential candidate Ekrem İmamoğlu, among other party officials on unfounded charges, it is evident that the government is determined to eliminate CHP leadership as a formidable political entity,” he stated. This court decision to annul the congress is an extraordinary intrusion into the internal operations of a political party. Attempts to disrupt a party’s internal elections or to impede its leaders from functioning as candidates infringe upon the rights to freedom of association (Article 11) and the right to free and fair elections (Article 3, Protocol 1) as outlined in the European Convention on Human Rights. Türkiye has a troubling history of unlawfully disrupting or dissolving political parties, and the Erdoğan administration's ongoing tactics to undermine the CHP spark serious violations that threaten basic democratic principles and human rights. Examining the timeline behind this leadership case indicates a clear political motive behind President Erdoğan's actions to have Özel ousted, according to Human Rights Watch. During the local elections in March 2024, the CHP, led by Özel, garnered 37.8 percent of the national vote, overtaking President Erdoğan's Justice and Development Party (AKP), which received 35.5 percent, marking a historic shift in the political landscape after 22 years. In October 2024, Erdoğan began making speeches insinuating that Özel's election as leader at the 2023 convention was questionable. In February 2025, the Ankara public prosecutor's office launched an investigation based on complaints from several former and current CHP members opposed to Özel. These complaints suggested, albeit without substantive evidence, that Özel's election involved vote-buying practices. The CHP leadership denounces these claims. After a series of hearings, the Ankara administrative court dismissed the complaints in October 2025, noting that Özel had been elected at subsequent gatherings in 2025. This led the accusers to appeal to the Ankara regional court, which on May 21 validated their complaints, annulled the 2023 congress, and invalidated the following congresses where Özel was reelected, all without providing evidence for its ruling. A distinct ongoing criminal case in the Ankara 26th Criminal Court of First Instance is investigating accusations that İmamoğlu and 11 others allegedly incentivized delegates to vote for Özel. This indictment rests on vague assertions lacking substantiated proof of any crime. Following the court ruling, Özel and the party leadership gathered at the Ankara party headquarters. In a news conference, Özel declared his commitment to remaining in the party and accused the legal system of orchestrating a coup against the opposition. Justice Minister Akın Gürlek characterized the court's ruling as "reinforcing our citizens' faith in democracy.” Interestingly, Gürlek was the Istanbul chief public prosecutor in October 2024 when the investigations against the CHP commenced. Following the completion of inquiries into İmamoğlu on February 10, 2026, Gürlek assumed the position of justice minister. On May 22, the newly appointed leadership of Kılıçdaroğlu, designated by the court, promptly dismissed the three CHP lawyers responsible for initiating the appeal to the Court of Cassation regarding the ousting of Özgür Özel's leadership, replacing them with new representatives who swiftly moved to withdraw that appeal.
