The CMA began its investigation into Emma Sleep in 2022, driven by concerns that its discount schemes, countdown clocks, and urgency messages could mislead customers, forcing them into quick purchases. Following Emma Sleep’s failure to address these issues, court action emerged in 2024. Notably, this case was handled before the CMA's updated consumer regulations took effect. As of April 2025, the CMA can independently determine legal violations without court intervention. If proven, companies risk fines up to 10% of their global turnover and mandates to refund customers, expanding the CMA's authority beyond the limitations in the Emma Sleep case. Since the implementation of these new powers, the CMA has investigated 14 additional businesses, wrapping up its inquiry into the AA, which resulted in £4.2 million in fines and £760,000 in consumer refunds.
