Habré Conviction: 10 Years of Shaping Global Justice

The **Habré conviction** in 2016 marked a significant advancement in the fight for justice concerning atrocity crimes, as noted by Human Rights Watch and the International Commission of Jurists (ICJ). This landmark verdict concluded a grueling 25-year legal battle led by the victims of former Chadian dictator Hissène Habré. It stands as the initial instance where a domestic court in one nation held and convicted a former leader from another country for serious international crimes, utilizing the principle of universal jurisdiction. On May 30, 2016, the Extraordinary African Chambers (EAC), an African Union-supported tribunal operating within the Senegalese judiciary, sentenced Habré to life imprisonment for crimes against humanity, war crimes, and acts of torture, which included sexual slavery and rape. Habré ruled Chad from 1982 until 1990, backed by the US and France. His regime was notorious for extensive political killings, systematic torture, and countless arbitrary arrests. Habré passed away in August 2021, after spending eight years in custody. Reed Brody, an ICJ commissioner and an advocate for Habré’s victims through Human Rights Watch, emphasized the significance of the case: “Habré’s victims pursued him for 25 years and brought him to justice when nearly everyone said it was impossible. Their message to today’s dictators is: justice can catch up with you. And to victims everywhere: don’t give up.” The **Habré conviction** has notably influenced the landscape of international justice, according to both the ICJ and Human Rights Watch. The EAC served as a blueprint for the establishment in December 2024 of the statute for a Gambia-Economic Community of West African States hybrid tribunal, aimed at addressing crimes under the regime of former Gambian president Yahya Jammeh. Following the 2012 International Court of Justice ruling in Belgium v. Senegal, the Extraordinary African Chambers were established. This ruling mandated Senegal to either prosecute Habré or extradite him under the United Nations Convention Against Torture. It also stipulated that Senegal held obligations to all treaty member states—erga omnes partes—allowing any nation that ratified the treaty, such as Belgium, to seek legal recourse through the International Court of Justice for noncompliance. This legal framework later guided Canada and The Netherlands’ case against Syria regarding alleged torture, as well as the cases of Gambia v. Myanmar and South Africa v. Israel under the Genocide Convention. Liz Evenson, the international justice director at Human Rights Watch, remarked, “The Habré case delivered a trial of a former head of state in a regional court with an African Union mandate, and with survivors at the center. The campaign for justice for Habré’s crimes continues to inspire accountability efforts in Africa and around the globe.” The ruling also advanced legal standards concerning torture and sexual violence, including findings determining that sexual slavery constitutes a part of the customary international law prohibiting slavery as a war crime and as a crime against humanity. Notably, Chadian rape survivors broke their 25-year silence to testify during the proceedings. In April 2017, the conviction was reaffirmed by the EAC Appeals Chamber, which awarded approximately €123 million in reparations to nearly 7,400 identified victims and survivors. In 2024, approximately €15 million was distributed to survivors and their families by the Chadian government, amounting to roughly €1400 for each victim. Although this distribution was a long-awaited yet partial success, it was riddled with discrepancies. The African Union trust fund, intended to manage and distribute reparations as per EAC directives, has yet to commence operations. In Chad, a concurrent 2015 conviction of 20 senior members of Habré’s political police included reparations and an order to establish a memorial and convert the police headquarters into a museum—neither of which has been acted upon. The Chadian government has attempted to rehabilitate Habré’s memory, as remarked by the ICJ and Human Rights Watch. Additionally, Brody was expelled from Chad in 2024 during his return to engage in a conference focused on the legacy of the case. The two organizations stated that this anniversary should prompt the African Union, Senegal, Chad, and donor nations to fully follow through on reparations, address documented irregularities in the 2024 Chadian distribution, activate the African Union trust fund, and implement the symbolic measures mandated by the Chadian courts. “Ten years later, the survivors who made this trial happen are still waiting for the full reparations which courts granted them, and for the government to recognize their suffering,” asserted Jacqueline Moudeina, the victims’ Chadian attorney. “The legacy of this case will be measured not only by what the judges wrote 10 years ago, but by what the Chadian government does now.” For more information on the impact of international justice, visit [The International Justice Resource Center](https://ijrcenter.org) and [The United Nations Human Rights Office](https://www.ohchr.org).
