Syria Trial Marks Crucial Step for Assad’s Victims

Syria trial marks a significant moment as a former official from Bashar al-Assad's regime faced court charges for the first time on Sunday. This event underscored the ongoing desire for justice among the families of the many victims. While some view this as a beginning, there are growing concerns about the commitment of Syria's new authorities to hold numerous perpetrators accountable. The atmosphere in the Palace of Justice was charged as the crowd chanted, "People want to hang Atef Najib!" Najib, who was the former head of the Political Security intelligence agency in Deraa, is accused of "crimes against the Syrian nation." Boisterous cries of "Signs of victory have arrived from Houran" echoed in the courtroom, a phrase tied to the early signs of the uprising, which began in Deraa back in 2011. This uprising ultimately escalated into a civil war. Families of regime victims gathered, anxiously awaiting the arrival of Najib, Assad's cousin. This trial represents the first of its kind, taking place in a court specifically established for such cases. One grieving mother sat silently, tears streaming down her face while others shouted slogans like "death and no humiliation" and "Syria for us and not for the Assad regime." Everyone felt a moment of justice—a chance for their loved ones who lost their lives under Assad to finally find peace. Dressed in a black-and-white prison uniform, Najib entered and stood behind bars while the families observed. He faces prosecution for crimes linked to Deraa during the uprising, an outcry sparked by the brutal treatment of protesters, particularly after several boys were tortured for writing anti-government messages inspired by the "Arab Spring." Reports indicate that Najib callously met with families of the tortured boys, stating, "Forget your children. If you want children, make more children. If you don't know how, bring us your women and we will make them for you." Under the Assad regime, human rights activists and protesters faced severe penalties at the same Palace of Justice, often culminating in death sentences following unjust trials. It is now a twist of fate that former officials are being held accountable in this very place. Nuha al-Masri, a 54-year-old lawyer from Deraa, initiated legal action against Najib and attended the court session. Her brother was killed during the crackdown on protests in March 2011. "Today, we feel we started to see justice. It shows that no one is above the law. It's fulfilling to witness a regime member in chains," she expressed. However, critics argue that Najib's trial may be more of a spectacle than a genuine effort toward accountability. Anwar al-Bunni, a prominent Syrian human rights lawyer and head of the Syrian Centre for Legal Studies and Research, emphasized that there is no effective legal framework for prosecuting war crimes or crimes against humanity in Syria. He commented, "They are belittling Najib's crimes and mocking the victims with this trial. This should occur only when a comprehensive law for war crimes is established by parliament, preferably investigated by a specialized body like the Commission for Transitional Justice; not by this court lacking experienced judges." Zahra Barazi, vice-president of the National Commission for Transitional Justice, stated they were collaborating with the justice ministry on this case. "We are drafting a Transitional Justice law to ensure that once approved, new charges of war crimes and crimes against humanity can be pursued effectively," she noted. "The court itself comprises specialized Transitional Justice judges." Interim President Ahmed al-Sharaa reaffirmed that the pursuit of justice is a "supreme goal" for his administration. The new Islamist government in Syria has apprehended several members of the Assad regime, with the most recent being Amjad Youssef, who is implicated in the infamous Tadamon massacre of 2013. In this brutal incident, 41 civilians were executed and disposed of in a pit. Yet there remains significant scrutiny regarding the government's handling of former regime officials who stand accused of serious offenses. For instance, former pro-Assad militia commander Fadi Saqr has been linked to the Tadamon killings but is currently cooperating with the government's civil peace commission, raising alarms among activists regarding true accountability. Despite controversies, the commencement of this Syria trial has brought a measure of closure to some victims' families and reignited hope that the journey towards justice may finally be underway.
