UK-EU SPS Agreement: Essential Business Insights

The UK-EU SPS Agreement, established on 19 May 2025, marks a collaborative effort between the UK government and the European Union (EU) to enhance trade regulations. This agreement, coupled with the Windsor Framework, aims to simplify and reduce costs associated with the movement of goods, benefiting not just cross-border trade between the UK and the EU but also the internal movement within the UK, such as from Great Britain to Northern Ireland. This SPS Agreement addresses several vital areas, including the trade, production, and transit of plants and animals alongside their products. It also encompasses food and feed safety, nutrition-related matters—including food supplements and fortified foods—and crucial agri-food regulations like food labeling and organic standards. Additionally, it will govern pesticide and biocide regulations. The application of the SPS Agreement will vary by sector, predominantly affecting farmers, primary producers, food and drink businesses, logistics providers, and importers/exporters of SPS goods. It will also impact pesticide and biocide suppliers, retailers, wholesalers, and horticultural professionals, as well as veterinarians. The agreement is expected to be implemented by mid-2027. Agri-food businesses are encouraged to start their preparations now, even if they currently do not engage in EU trade. From May 2026, the government will offer comprehensive guidance and support to facilitate a seamless transition for all stakeholders. Key benefits of the UK-EU SPS Agreement include potential cost savings by eliminating the necessity for Export Health Certificates and certain routine border checks. This initiative aims to expedite trade, allowing fresh produce to reach consumers more swiftly while fostering resilient supply chains and opening new markets for products like fresh sausages, shellfish, and seed potatoes. It is also projected to help alleviate consumer food price inflation. UK businesses will need to adhere to applicable EU regulations within the framework of the SPS Agreement. This may necessitate adjustments in operations, such as updating processing techniques, certifications, or labeling practices. From May 2026, detailed guidance will be provided through written resources, webinars, checklists, and specialized tools. A stakeholder advisory board will facilitate continuous communication with businesses. Import checks on goods from the Rest of the World will persist, likely aligning inspection protocols with EU standards for these products. There is an expectation of increased inspection rates for certain commodities from the Rest of the World, with additional details forthcoming. The government has conducted a Call for Information, receiving 489 responses from the agri-food sector. Most respondents are aware of the SPS Agreement and are in search of practical guidance. Many anticipate some changes, acknowledging benefits such as reduced compliance costs and enhanced market access, while also identifying potential impacts on compliance and supply chains. Businesses can begin their preparations by networking with trade associations, engaging with supply chains, signing up for Defra email alerts, and seeking assistance from agencies including the Department for Business and Trade and the Food Standards Agency. The government is committed to collaborating closely with industry and devolved governments to keep businesses updated and supported through regular webinars, workshops, and newsletters.
